Hosting Terms and Conditions.

 

These terms and conditions are intended to protect both the integrity and liability of Kieran Kelly and The Applicant.

 

Payment:

 

  • Payment is in advance for retail and reseller customers.

 

Cancellation Policy:

 

In respect of annual payments if you cancel any subscriptions before the end of the annual contract you will not be entitled to a refund of all or part of amounts already paid by you. Register.ie requires at least 30 days notice for the cancellation of any services or accounts. Refunds will be issued from the end of the 30 days period to the next billing period

 

Additional Charges

 

  • Clients will be provided one website restore free of charge. Additional website restores will be charged at our standard restore rate.
  • Hosting fees do not include additional work and tasks related to identifying and fixing hacked websites. Such tasks will be charged for at our standard hourly rate.
  • If we identifies phishing, spamming or hacking out of hours and such a website requires attention in order to protect the integrity of the website or the Kieran Kelly network then the Client agrees to Kieran Kelly carrying out such work or tasks and charging the Client at the standard hourly rate.
  • DNS changes will be made free of charge provided the Clients domain name is registered with Kieran Kelly.
  • Email setup management is not included in hosting. We recommend 3rd parties only for Email management. This is to ensure the client gets a great service.
  • Clients will be provided one website restore free of charge. Additional website restores will be charged at our standard restore rate.
  • Website changes/updates are not included in hosting charges.
  • Plugin updates can effect your website/layout. Kieran Kelly is not responsible for the updates.

 

Unlawful or Prohibited Usage

  • The Applicant will not use the Kieran Kelly services for any purpose that is unlawful or prohibited by these terms and conditions.
  • The Applicant will not use the Kieran Kelly services for any purpose that is unlawful or prohibited by these terms and conditions.
  •  The Applicant may not obtain, or attempt to obtain, any materials or information through any means not intentionally made available through the Kieran Kelly services.
  • Kieran Kelly reserves the right at all times to disclose any information as Kieran Kelly deems necessary to satisfy any applicable law, regulation, legal process or court order, or to edit, refuse to post or to remove any information or materials, in whole or in part, at Kieran Kelly’s’ sole discretion.

 

Third Party

 

Any dealings with third parties (including advertisers) included within the Kieran Kelly services or participation in promotions, including the delivery of and the payment for goods and services, and any other terms, conditions, warranties or representations associated with such dealings or promotions, are solely between The Applicant and the advertiser or other third party. Kieran Kelly shall not be responsible or liable for any part of any such dealings or promotions.

 

 

 

Termination

 

Termination by the Applicant

 

  • With the exception of dedicated servers, this agreement may be terminated at any time by the Applicant by giving Kieran Kelly 30 days notice in writing.
  • Termination must be made on company letter heading and be dated and signed by a person recognised by Kieran Kelly. (electronic e-mail message being regarded as writing for this purpose).

 

Termination by Kieran Kelly.

 

Kieran Kelly may cancel this agreement, suspend delegation of a domain name or cease providing hosting services on seven days written notice (electronic e-mail message being regarded as writing for this purpose) if:
